CONSTITUTIONAL AND LEGAL FOUNDATIONS OF THE ACTIVITY OF STATE AND NON-STATE EDUCATIONAL ORGANIZATIONS IN THE FIELD OF EDUCATION

Abstract: This article examines the constitutional and legal foundations of the
activity of state and non-state educational organizations in the Republic of Uzbekistan.
Based on Articles 50 and 51 of the Constitution of the Republic of Uzbekistan in the
new edition of 2023, the Law “On Education” of 23 September 2020, and by-laws
aimed at developing public-private partnership in education, the article reveals the
content of state guarantees of the right to education and the legal status of non-state
educational organizations. A comparative analysis of the constitutional and legislative
models of Germany, the Russian Federation, the People’s Republic of China and the
Republic of Kazakhstan, as well as international standards (Article 26 of the Universal
Declaration of Human Rights, Article 13 of the International Covenant on Economic,
Social and Cultural Rights), is carried out. Proposals are substantiated for improving
national legislation, including clarifying the criteria for licensing non-state
educational organizations, strengthening guarantees of the stability of state support
measures, and developing mechanisms of state control over the quality of education
while respecting the autonomy of educational organizations.
